These SMS Terms & Conditions (“Terms”) govern your use of www.thevirtualsolopreneur.com (the “Site”), operated by Effie Stamos, LLC, d/b/a The Virtual Solopreneur (“Company,” “we,” or “us”), and apply to all SMS communications, content, purchases, and services provided via the Site.

To participate in our SMS notifications service, you must:

  • Be 18 years of age or older.​

  • Own a wireless device capable of two-way messaging.​

  • Be a subscriber to a wireless service with text messaging capabilities.

 

12. Dispute Resolution and Arbitration:

 

If you have any complaint or if any issue arises in connection with your use of The Virtual Solopreneur’s SMS communications, please contact us directly at effie@thevirtualsolopreneur.com so we may attempt to resolve the matter informally.

If we are unable to resolve your dispute amicably, you agree that you and Effie Stamos, LLC (The Virtual Solopreneur) shall submit the dispute to binding arbitration with the American Arbitration Association (AAA), before a mutually agreed-upon arbitrator, in accordance with AAA’s rules.

By agreeing to this clause, you understand that you are waiving your right to a jury trial in court, which would otherwise be available to you. If any arbitration hearing is required, it shall be held virtually or within 20 miles of New York, New York, unless otherwise agreed.

If the arbitrator issues an award, the judgment will be binding and may be entered in a court in the State of New York. The only remedy available through arbitration will be a refund of any payment made to Effie Stamos, LLC (The Virtual Solopreneur) for the applicable service or product. You expressly agree not to seek or be entitled to any consequential, punitive, or exemplary damages.

Nothing in this clause prevents either party from filing an individual claim in small claims court if it qualifies.

 

13. Miscellaneous:

 

You warrant and represent that you have the necessary rights, power, and authority to agree to these Terms and perform your obligations herein. If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
